Chapter 1 General Provisions
Article 1 (Purpose)
The purpose of these Terms and Conditions is to define matters concerning the use of internet-related services (hereinafter referred to as the "Services") provided on the website operated by the Korean Association for Artificial Intelligence and Law (hereinafter referred to as the "Association").
Article 2 (Definitions)
1. Member (User): A person who logs in to the website and receives services provided by the Association in accordance with these Terms and Conditions.
2. Administrator: A person selected by the Association for the overall management and smooth operation of the Services.
3. ID: A combination of letters and numbers selected by the member and assigned by the Association for identifying the registered member and for the member's use of the Services. Since the Association performs various member management tasks, including deposits into customer accounts, based on the member ID, if a member wishes to change their member ID, the Association will restrict such change unless there is a clear reason for the change.
4. Password: A combination of letters and numbers selected by the member to verify that the user matches the assigned ID and to protect the member's rights and interests.
5. Termination: The cancellation of the service agreement by the user after the Services have been opened.
Article 3 (Posting and Amendment of the Terms)
1. The Association posts these Terms and Conditions, along with the name of the Association, its location, and its email address, on the website so that members can review them.
2. The Association may amend these Terms and Conditions within the scope not violating relevant laws and regulations when unavoidable circumstances arise.
3. When amending the Terms and Conditions, the Association shall specify the effective date and the reason for the amendment and announce them on the service screen together with the current Terms and Conditions from 30 days before the effective date until the day before the effective date.
4. Matters not specified in these Terms and Conditions and the interpretation of these Terms and Conditions shall be governed by relevant laws and regulations or customary practice.
Article 4 (Content of Services and Changes)
1. The Association provides the following services.
1. Information on the Association's news
2. Academic information provided by the Association
3. Information on Association members
4. Other services determined by the Association
2. The Association may change the content of the services provided when unavoidable circumstances arise. In such cases, the Association shall notify users through the notices board from 7 days before the date of provision by specifying the changed service content, the reason for the change, and the date of change.
3. In the case set forth in the preceding paragraph, if the changed content is material or is applied in a significantly unfavorable manner to the services as a whole, the Association shall individually notify the member in the manner prescribed in Article 8 and obtain consent. In such case, the Association shall provide the pre-change service to members who refuse consent; if it is impossible to provide the service, the Association may terminate the contract.
4. The Association shall be liable to compensate for damages suffered by a user due to changes in the content of the Services if there is intent or gross negligence.
Article 5 (Suspension of Services)
1. The Association may temporarily suspend the provision of Services in the event of maintenance, inspection, replacement, or failure of equipment such as systems, communication failure, or other force majeure reasons.
2. If damages are caused to a member or a third party due to a temporary suspension of service provision for the reasons set forth in Paragraph 1, the Association shall be liable to compensate for such damages if there is intent or gross negligence.
Chapter 2 Membership Enrollment and Withdrawal
Article 6 (Membership Registration)
1. A member applies for membership by entering member information in the form prescribed by the Association and indicating agreement to these Terms and Conditions.
2. The Association shall register as members users who apply for membership as described in the preceding paragraph, unless they fall under any of the following items.
1. Where the applicant has previously lost membership status pursuant to Article 7, Paragraph 2 of these Terms and Conditions
2. Where there is false information, omission, or error in the registration details
3. Where the Association determines that registering as a member would significantly hinder the Association's technical or operational performance
3. The membership agreement shall be deemed concluded at the time the Association approves the application.
4. For associations linked to an online submission system, the information of registered members will be automatically registered in the submission system.
5. If there are any changes to registered information, the member must update the changes on My Page within the website and notify the Association of the changes.
Article 7 (Member Withdrawal and Loss of Status, etc.)
1. A member may request withdrawal from the Association at any time, and the Association shall process the withdrawal immediately. However, re-registration under the same ID after withdrawal is not permitted.
2. If it is necessary to restrict a member's use of the Services because the member falls under any of the following items, the Association may restrict the member's use of the Services after giving prior notice of the scope, period, and reason for the restriction. However, if a member violates the current law and causes damage to the company through intentional or gross negligence, the Association may terminate the service agreement without prior notice.
1. Where false information was registered at the time of application
2. Where the order of the site is threatened, such as by interfering with another person's use of the Services or misappropriating their information
3. Where operation of the website is interfered with, such as by changing information provided within the Association
4. Where a person uses the Association to engage in acts prohibited by laws and regulations or these Terms and Conditions, or contrary to public order and morals
5. Where these Terms and Conditions are violated
6. Where it is otherwise deemed inappropriate to maintain the member's status
Article 8 (Notice to Members)
1. When giving notice to a member, the Association may do so via the email address or mobile message provided by the member to the Association.
2. In the case of notice to an unspecified number of members, the Association may substitute individual notice by posting on the bulletin board.
Chapter 3 Protection of Personal Information
Article 9 (Protection and Use of Personal Information)
1. The Association strives to protect users' personal information in accordance with relevant laws and regulations, including the Act on Promotion of Information and Communications Network Utilization and Information Protection, etc. and the Personal Information Protection Act.
2. The protection and use of personal information shall be governed by relevant laws and the Association's Privacy Policy. However, the Association's Privacy Policy does not apply to linked sites other than the Association's website. In addition, the Association assumes no responsibility whatsoever for information disclosed due to the user's own fault..
Chapter 4 Obligations of the Association and Users
Article 10 (Obligations of the Association)
1. The Association shall not engage in acts prohibited by laws and regulations or these Terms and Conditions, or contrary to public order and morals, and shall make its best efforts to provide the Services continuously and stably in accordance with these Terms and Conditions.
2. The Association shall make its best efforts to ensure information security by taking technical safety measures and exercising utmost care in management regarding the security of users' personal information, including credit information.
3. The Association shall contribute to the development of internet business by maximizing customer satisfaction through the provision of high-quality services through fair and sound operation, as well as continuous research and development.
4. The Association shall not send commercial email advertisements for profit that the user does not want.
Article 11 (User's Obligations Regarding Passwords)
1. Users must use a password when using the Association's Services.
2. Users are responsible for all management of their passwords.
3. Users must not allow a third party to use their password.
4. Users bear all responsibility arising from inadequate management of their passwords.
5. If a user becomes aware that their password has been stolen or is being used by a third party, the user must immediately notify the Association and follow the Association's instructions, if any.
Article 12 (Users' Obligations)
1. Users must not engage in the following acts.
1. Registering false information when applying or making changes
2. Altering information posted by the Association
3. Transmitting or posting information other than that designated by the Association (such as computer programs)
4. Infringing the intellectual property rights, including copyrights, of the Association or any third party
5. Acts that damage the reputation of the Association or interfere with the work of any third party
6. Acts of disclosing or posting on the Association any obscene or violent messages, images, audio, or other information contrary to public order and morals
7. Acts of selling goods or arranging sales
8. Other acts deemed inappropriate
② If any information listed in the preceding paragraph or other information deemed inappropriate by the Association for site operation is posted on the homepage or on a site linked to it, the Association may delete the relevant information posted on the homepage or sever the link without the consent of the user or the person who posted such information. However, the Association is under no obligation to delete such information or sever such links.
Chapter 5. Miscellaneous
Article 13 (Ownership of Copyright and Restrictions on Use)
① Copyright and other intellectual property rights in works created by the Association shall belong to the Association.
② Users shall not, without the Association's prior consent, use information obtained through use of the homepage for commercial purposes by means of reproduction, transmission, publication, distribution, broadcasting, or any other method, or allow a third party to use it.
Article 14 (Dispute Resolution)
① Disputes concerning all matters related to the use of services arising other than those stipulated in these Terms of Use shall be resolved, to the fullest extent possible, by mutual agreement between the parties.
② If a user has complaints or wishes to submit an opinion regarding the use of the homepage, the user may submit such complaints or opinions about the homepage by email.
③ If the Association determines that complaints and opinions submitted by users are justified, it shall give priority to handling the matter. However, if prompt handling is difficult, the Association will immediately notify the user of the reason and the processing schedule.
Article 15 (Jurisdiction and Governing Law)
① Any lawsuit concerning a dispute arising from the use of services between the Association and a user shall be brought before the exclusive jurisdiction of the district court having jurisdiction over the member's address in the Republic of Korea at the time of filing. If there is no address, the district court having jurisdiction over the place of residence shall have exclusive jurisdiction. However, if the member's address or place of residence at the time of filing is unclear, or if the member resides overseas, the court having jurisdiction under the Civil Procedure Act shall apply.
② Korean law shall apply to electronic transaction lawsuits filed between the Association and a user.
